User Agreement

This User Agreement ("Agreement") is a binding contract between you ("User") and SEBA ("we", "us") governing your use of the PROP English learning platform. This Agreement supplements the Terms & Conditions and Privacy Policy, which are incorporated by reference. By creating an account or using the Platform, you agree to all terms of this Agreement.

1. User Categories and Roles

The Platform recognises the following user roles, each with specific rights and responsibilities:

Students

Students are individuals enrolled in the Platform for the purpose of learning English. Students may access exercises, assessments, their personal dashboard, progress records, badges, and the leaderboard. Students may not access other students' personal data or teacher-only administrative functions.

Teachers and Administrators

Teachers and administrators are authorised educational professionals who manage student accounts, assign exercises, monitor progress, and run assessments. They accept additional data protection responsibilities as outlined in the Terms & Conditions Section 8. Teacher/admin access is granted by the Platform owner and may be revoked at any time.

2. Account Registration and Age Requirements

The Platform is designed for users aged 12 years and over. The following age-specific rules apply:

• Ages 12–13 (Spain) / Ages 13 (USA, COPPA): Account creation requires explicit, verifiable consent from a parent or legal guardian. The consenting adult accepts this Agreement on the minor's behalf and is responsible for supervising the minor's use of the Platform.
• Ages 14–17: Users may register independently in Spain (per LOPDGDD Art. 7) but parental notification is strongly recommended. In jurisdictions where the age of digital consent is higher (e.g., 16 in some EU member states), parental consent is required.
• Ages 18+: Users may register and accept this Agreement independently.

3. Educational Use and Academic Integrity

The Platform is provided exclusively for genuine educational purposes. You agree to:

• Complete assessments and exercises honestly and without assistance from unauthorised sources.
• Not use automated tools, AI assistants, or other means to artificially inflate your scores or CEFR level.
• Not share assessment questions, answers, or exercise content outside the Platform.
• Acknowledge that placement assessment results are indicative only and do not constitute formal CEFR certification.
• Engage with the Platform in good faith to genuinely improve your English proficiency.

Violations of academic integrity may result in account suspension, level reset, or permanent ban from the Platform, at our sole discretion.

4. Gamification and Rewards

The Platform's gamification features — including XP points, badges, streaks, and leaderboard rankings — are provided for motivational purposes only. They have no monetary value, cannot be exchanged for cash or goods, and are not transferable between accounts. We reserve the right to adjust, reset, or remove gamification elements at any time without notice or compensation.

5. AI-Generated Content

The Platform uses artificial intelligence to generate personalised feedback on written exercises. You acknowledge that:

• AI feedback is generated automatically and may not always be perfectly accurate.
• AI feedback is intended as a learning aid and does not replace qualified human instruction.
• Your written submissions may be processed by AI systems to generate feedback; this processing is described in our Privacy Policy.
• You retain ownership of your original written submissions.

6. Offline Access and PWA Features

The Platform may be installed as a Progressive Web App (PWA) on your device, enabling offline access to previously loaded exercises and content. You acknowledge that:

• Offline progress will be synchronised with the server when you reconnect to the internet.
• Some features (e.g., AI writing feedback, leaderboard) require an active internet connection.
• We are not responsible for data loss caused by device failure or storage limitations during offline use.

7. Communication and Notifications

By creating an account, you consent to receive in-app notifications related to your learning activities, including assignment notifications, assessment reminders, badge awards, and streak alerts. You may manage notification preferences in your account settings. We will not send unsolicited marketing communications without your explicit consent.

8. Suspension and Termination

We reserve the right to suspend or terminate your account with or without notice if you:

• Violate this Agreement, the Terms & Conditions, or any applicable law.
• Engage in behaviour that disrupts other users' learning experience.
• Provide false information during registration.
• Remain inactive for more than 24 consecutive months.

Upon termination, your access to the Platform will cease. You may request a copy of your learning data before account deletion by contacting [email protected].

9. Feedback and Improvements

If you submit feedback, suggestions, or ideas about the Platform, you grant us a non-exclusive, royalty-free, perpetual licence to use, incorporate, and build upon that feedback without obligation to you. We are not required to implement any feedback received.

10. Dispute Resolution

In the event of a dispute arising from this Agreement, the parties agree to first attempt resolution through good-faith negotiation. If unresolved within 30 days, disputes shall be submitted to mediation before any legal proceedings are initiated. This Agreement is governed by the laws of Spain and the European Union, with exclusive jurisdiction in the courts of Catalonia, Spain.

11. Entire Agreement

This User Agreement, together with the Terms & Conditions, Privacy Policy, and Cookie Policy, constitutes the entire agreement between you and SEBA regarding your use of the PROP Platform and supersedes all prior agreements, representations, and understandings.
