1. Introduction and Acceptance

These Terms and Conditions ("Terms") govern your access to and use of the PROP English learning platform ("Platform"), operated by SEBA ("we", "us", "our"). By registering for or using the Platform, you confirm that you have read, understood, and agree to be bound by these Terms and all applicable laws and regulations.

If you are under 18 years of age, your parent or legal guardian must review and accept these Terms on your behalf. Use of the Platform by minors under 14 requires explicit written consent from a parent or legal guardian, in accordance with Spanish Organic Law 3/2018 (LOPDGDD) and EU Regulation 2016/679 (RGPD/GDPR).

2. Platform Description

PROP is a CEFR-aligned English language learning platform that provides personalised learning paths, placement assessments, gamified exercises, and progress tracking for students at all levels from A1 (Beginner) to C2 (Mastery). The Platform is designed for use in educational settings and is operated in accordance with the Common European Framework of Reference for Languages (CEFR) as published by the Council of Europe.

3. User Accounts and Registration

To access the Platform's features, you must create an account. You agree to:

  • Provide accurate, current, and complete information during registration.
  • Maintain the security of your password and accept responsibility for all activities under your account.
  • Notify us immediately of any unauthorised use of your account.
  • Not share your account credentials with any third party.
  • Not create multiple accounts for the purpose of circumventing restrictions or assessments.

We reserve the right to suspend or terminate accounts that violate these Terms, engage in fraudulent activity, or compromise the integrity of the Platform.

4. Acceptable Use Policy

You agree not to use the Platform to:

  • Violate any applicable local, national, or international law or regulation.
  • Transmit unsolicited communications, spam, or advertising materials.
  • Attempt to gain unauthorised access to any part of the Platform or its related systems.
  • Interfere with or disrupt the integrity or performance of the Platform.
  • Harvest or collect personal data of other users without their consent.
  • Upload or transmit viruses, malicious code, or any other harmful software.
  • Impersonate any person or entity, including teachers, administrators, or SEBA staff.
  • Use automated scripts, bots, or scraping tools to access the Platform.

5. Intellectual Property

All content on the Platform — including but not limited to text, exercises, assessments, graphics, logos, audio, software, and the CEFR-aligned curriculum — is the exclusive property of SEBA or its licensors and is protected by applicable intellectual property laws, including Spanish Royal Legislative Decree 1/1996 (Intellectual Property Law) and EU Directive 2019/790 on copyright in the Digital Single Market.

You are granted a limited, non-exclusive, non-transferable licence to access and use the Platform solely for your personal educational purposes. You may not reproduce, distribute, modify, create derivative works from, publicly display, or commercially exploit any content from the Platform without our prior written consent.

6. Educational Standards and CEFR Alignment

The Platform's content and assessment methodology are aligned to the Common European Framework of Reference for Languages (CEFR), published by the Council of Europe. CEFR levels referenced on the Platform (A1, A2, B1, B2, C1, C2) reflect internationally recognised descriptors for language proficiency. PROP's assessments are designed to provide indicative level guidance and should not be considered equivalent to formal CEFR certification examinations (e.g., Cambridge English, IELTS, or Trinity College London qualifications).

7. Privacy and Data Protection

Your use of the Platform is subject to our Privacy Policy, which is incorporated into these Terms by reference. We process personal data in accordance with:

  • EU Regulation 2016/679 (General Data Protection Regulation — RGPD/GDPR)
  • Spanish Organic Law 3/2018 on Personal Data Protection (LOPDGDD)
  • Spanish Law 34/2002 on Information Society Services (LSSICE)
  • US Children's Online Privacy Protection Act (COPPA) for users under 13
  • Canadian Personal Information Protection and Electronic Documents Act (PIPEDA)

8. Teacher and Administrator Responsibilities

Users with teacher or administrator roles accept additional responsibilities, including:

  • Ensuring that student accounts are created with appropriate parental consent where required by law.
  • Using student data only for legitimate educational purposes within the Platform.
  • Not exporting or sharing student personal data with unauthorised third parties.
  • Reporting any suspected data breaches or security incidents to SEBA immediately.
  • Complying with their institution's data protection policies in addition to these Terms.

9. Disclaimer of Warranties

The Platform is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Platform will be uninterrupted, error-free, or free of viruses or other harmful components.

10. Limitation of Liability

To the fullest extent permitted by applicable law, SEBA shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Platform, even if we have been advised of the possibility of such damages. Our total liability to you for any claim arising from these Terms shall not exceed the amount paid by you (if any) for access to the Platform in the twelve months preceding the claim.

11. Governing Law and Jurisdiction

These Terms are governed by the laws of Spain and, where applicable, the laws of theEuropean Union. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Catalonia, Spain, without prejudice to any mandatory consumer protection provisions applicable in your country of residence.

For users in the European Union, you may also submit complaints to your national data protection authority or use the EU Online Dispute Resolution platform at ec.europa.eu/consumers/odr.

12. Changes to These Terms

We reserve the right to modify these Terms at any time. We will notify registered users of material changes by email or by a prominent notice on the Platform at least 30 days before the changes take effect. Your continued use of the Platform after the effective date constitutes acceptance of the revised Terms.
